Colorado ‘Make-My-Day’ Defense

When you are in your home you may have the right, under qualifying circumstances, to use physical force, including deadly force, against an intruder. Under Colorado law, the so-called make-my-day provision, goes above and beyond your right to use physical force in defense of your home/property. It works as a bar to criminal charges of murder, manslaughter, assault and other charges arising from your use of force against an intruder.

Learn more about the Colorado make-my-day defense in a free consultation with one of the experienced attorneys at Jurdem, LLC, in Boulder. Call 303-800-3509 or toll-free at 877-761-7852. We will put decades of experience to work finding the best defenses available to you based on the facts of your case.

Can I Use The Make-My-Day Defense In My Case?

The make-my-day defense prevents a case from moving forward — it is, essentially, immunity from prosecution. To use the defense, however, you must establish by a preponderance of the evidence that:

  1. The intruder made an unlawful, or knowing criminal, entry into your home.
  2. You had reasonable belief that the intruder intended to commit a crime in your home.

Because the burden is on you or your lawyer to prove the points above, it is a good idea to work with an attorney experienced with this defense.

At Jurdem, LLC, our attorneys are experienced in successfully relying on defenses, such as the make-my-day law and self-defense, to defend against assault, disorderly conduct and related charges.
