Can I Use The Make-My-Day Defense In My Case?

The make-my-day defense prevents a case from moving forward — it is, essentially, immunity from prosecution. To use the defense, however, you must establish by a preponderance of the evidence that:

  1. The intruder made an unlawful, or knowing criminal, entry into your home.
  2. You had reasonable belief that the intruder intended to commit a crime in your home.
