Colorado law respects the right of a person to act in self-defense, in defense of others or in defense of property. If you believed that someone is using unlawful physical force against you, a loved one or your property, you may be able to use the self-defense defense in your case.

There are specific requirements that determine whether you can use self-defense to defend against your criminal charges. Contact Jurdem, LLC, to learn whether you acted in self-defense under Colorado law. Our Boulder, Colorado, attorneys have decades of combined experience finding defenses to a wide range of criminal charges.

Can I Claim Self-Defense In My Case?

The law recognizes the right to use physical force in self-defense or in defense of another from what the person reasonably believes to be the use or imminent use of unlawful physical force. In order to claim that you acted in self-defense, you must be able to show:

  • You had a reasonable belief that you were defending yourself against the use of unlawful force.
  • You used only the degree of force that you reasonably believed was necessary to protect yourself or a third party.
  • The use of unlawful force against you or another was imminent.

Unlike many other states, Colorado does not impose a duty to retreat before a person may use physical force in self-defense.
