On Behalf of | Feb 23, 2023 | Domestic Violence Charges

Being accused of domestic violence is very serious. There are severe penalties if convicted for such crimes, including lengthy jail terms. There are also certain stigmas attached to these types of crimes.

Nonetheless, it’s important to remember that all accused parties are innocent until proven guilty. While rare, false accusations do occur.

Why would anyone make up allegations of domestic violence? Outlined below are two of the main motivators for making false accusations of this type.

1. Relationships gone wrong

The reality is that many relationships just don’t last the course. In an ideal world, each partner would accept that it isn’t working and just move on with their lives amicably.

Unfortunately, this is often not the case. One partner may have no interest in ending the relationship and may become aggrieved when the other leaves. False accusations of domestic violence are often filed as an attempt at revenge.

2. A stronger position in the family court

The end of a long-term relationship or marriage can result in lengthy disputes in the family court. Each spouse will be looking to gain a stronger position and prove that they are the more responsible parent.

Sometimes, one parent may choose to play unfairly by lodging false accusations against the other party. There are few more damaging accusations than those of domestic violence.

You may feel overwhelmed when facing accusations of domestic violence, but the good news is that there is help out there. You are innocent until proven guilty beyond all reasonable doubt and legal guidance will help you to assess your defense options.
