Protection Orders/Restraining Orders

Restraining orders and protective orders can come about in domestic violence situations and during family law matters such as divorce. In criminal cases, restraining orders are often issued by the court even when the protected party doesn’t want one to be issued. Once one of these types of orders is in place, compliance can be exceptionally burdensome. Under the conditions of many restraining orders:

  • You will not be able to go to your home
  • You will not be able to see your children
  • You will not be able to contact the party who secured a restraining order
  • You will not be able to possess a firearm
  • You will not be allowed to consume alcohol

Violation of any of the terms of your restraining order is a crime carrying a potential two-year jail sentence that may lead to the creation of yet another restraining order. This can create a vicious cycle. This is especially prone to occur when the other party is not interested in following the terms of the restraining order either. They may have secured the order and then had a change of heart or there may have been a domestic violence situation and a restraining order was involuntarily imposed by the court.

Restraining Order Attorney In Boulder

At Jurdem, LLC, our Boulder restraining order defense attorneys understand the complex emotions that can be a part of a situation where a restraining order is in place. The attorneys of our firm bring together decades of experience negotiating and trying these cases. We can use that experience to get you the best possible result if you have been accused of violating a restraining order.

For couples who want to be together in spite of a court order prohibiting them from doing so, we can help. “Consensual violation” is the phrase commonly used when both parties are willfully and voluntarily violating the terms of the restraining order of their own accord, either by communicating with each other or by continuing to live together. Keep in mind that once a restraining order is in place, even if both parties want contact with each other, contacting the protected party is a crime.

Whether you are accused of violating a restraining or protective order because of harassment or stalking, or any other reason, we can help present to the court a persuasive and effective case for why the order or orders should be lifted and you should be allowed to be together.
