Under Colorado law, criminal record expungement is not available for offenses committed as an adult. While many adult criminal records can be sealed, only juvenile records can be expunged. What is the difference between record sealing and expungement? Sealing a criminal record renders the criminal charge and arrest records unable to be seen on routine background checks by prospective employers, creditors, landlords and others. It is important to note, however, that sealed records can be viewed by law enforcement and under special circumstances such as professional licensing background checks. Expungement involves the removal of all traces of a criminal offense from a person’s criminal record. It is as if the incident and resulting legal action never took place.
