Penalties For Burglary In Colorado

Entering a dwelling to commit a crime is a class three felony with a potential sentence of four to 12 years in the Colorado Department of Corrections. Unlawfully entering or remaining in a building or occupied structure that is not a dwelling to commit a crime is a class four felony with a potential sentence of two to six years.

When a person enters property of a past or present intimate partner without permission, the offense will be charged as an act of domestic violence and, if convicted, the person will be ordered to complete a treatment program and treatment evaluation complying with the standards adopted by the Domestic Violence Offender Management Board.

There are also greater penalties if the burglary was committed with the intent to steal a controlled substance, or if the alleged burglar has been previously convicted of burglary.
